Background: What is the EUDR?

The recently introduced European Regulation (EU) 2023/1115 concerning deforestation-free products (EUDR) seeks to encourage the use of products that are free from deforestation and minimize the EU's contribution to global deforestation and forest degradation. The regulation is anticipated to contribute to the reduction of greenhouse gas emissions and biodiversity loss by banning the import of coffee that is not provenly deforestation-free and requiring comprehensive documentation of due diligence practices.

The regulation is applicable to operators and traders, thus companies engaged in the importing, processing and selling of coffee. (Soluble coffee is presently excluded from the EUDR's scope.) Other commodities covered by the regulation include cattle, cocoa, oil palm, rubber, soy and wood. All participants and traders within the EU value chain bear the responsibility of ensuring compliance with the EUDR. Specific provisions have been outlined for small and medium-sized enterprises.

The regulation stipulates that only deforestation-free coffee produced in compliance with the applicable laws of the producing country is permissible for import, sale within the EU and export from the EU. The defined cut-off date for deforestation is December 31, 2020. A thorough due diligence process is mandated, encompassing information collection, risk assessment and risk mitigation. The due diligence process must also address various aspects such as the presence of indigenous people, labor rights, human rights, land use rights and more.

The regulation came into force on 29 June, 2023 and its full implementation commences on December 30, 2024. For micro and small enterprises the application starts on 30 June, 2025.
